Scratch That Veggie Itch Promotion
Terms and Conditions
1. Eligibility:
The Scratch That Veggie Itch Promotion (“Promotion”) is open only to legal residents of the 48 contiguous United States or Washington, DC, who are at least 18 years of age, or the age of majority in their jurisdiction of residence, whichever is older, at the time of participation. Void in Alaska, Hawaii, Nevada, and where prohibited by law.
Employees, officers, directors, contractors, representatives, and their immediate family members (parents, children, spouses, and siblings, regardless of residence) of Earth Burger, Inc., its parent company, subsidiaries, divisions, affiliates, agencies, and any entities involved in implementing the Promotion (collectively, “Sponsor”) are not eligible.
By participating, each participant represents that they meet the eligibility requirements and agrees to comply with these Terms and Conditions (“Promotion Terms”) and Sponsor’s decisions concerning administration of the Promotion.
2. Promotion Schedule:
The Promotion begins on October 1, 2026, during normal business hours at participating Earth Burger locations and continues while scratch-card supplies last.
All discounts and prizes must be redeemed during normal business hours no later than November 30, 2026. Unredeemed discounts and prizes expire after that date.
3. How to Participate:
Obtain an official Scratch That Veggie Itch promotional scratch card at a participating Earth Burger location while supplies last. Scratch the designated area to reveal the discount or prize indicated on the card.
Scratch cards are subject to availability at each participating location. A location may stop distributing cards once its supply is depleted. No rainchecks will be provided for unavailable scratch cards.
4. Discounts, Prizes, and Redemption:
The discount or prize revealed on an official scratch card is subject to these Promotion Terms and any additional conditions printed on the card.
In-store or drive-thru only: Redemption is available at participating Earth Burger locations in-store or through the drive-thru.
Third-party delivery excluded: Discounts and prizes are not valid on orders placed through third-party delivery services.
Cannot be combined: Discounts and prizes may not be combined with any other discounts, coupons, offers, or promotions.
Cannot be used on a Daily Deal offer.
No cash redemption: Discounts and prizes have no cash redemption value and cannot be exchanged for cash.
Redemption deadline: All discounts and prizes must be redeemed by November 30, 2026.
Card presentation: Present the original scratch card when ordering and surrender it upon redemption. Each card may be redeemed only once.
Valid cards required: Copied, altered, counterfeit, previously redeemed, or otherwise invalid cards will not be accepted. Cards must be sufficiently legible to verify the offer.
No substitutions are permitted. Discounts and prizes are nontransferable and nonassignable. Any applicable taxes, additional purchases, or other expenses not expressly included in the offer are the participant’s responsibility.
5. Publicity:
Except where prohibited by law, participation constitutes the participant’s consent to Sponsor’s use of their name, likeness, photograph, voice, opinions, biographical information, hometown, and state for promotional purposes in any media without additional payment or consideration.
6. Limitations of Liability:
To the fullest extent permitted by law, Sponsor and its agencies are not responsible for:
Incorrect or inaccurate information caused by participants, printing errors, or equipment or programming associated with the Promotion. In the event of a conflict between advertising materials and these Promotion Terms, these Promotion Terms will govern.
Technical failures, including website or restaurant point-of-sale malfunctions, interruptions, or network, hardware, or software failures.
Unauthorized intervention in the participation or redemption process.
Technical or human errors in administering the Promotion or processing redemptions.
Injury or damage to persons or property arising from participation, acceptance or use of a discount or prize, consumption of a prize item, or travel to or from a Promotion-related activity.
Sponsor reserves the right to disqualify any individual who tampers with the Promotion, uses fraudulent cards, or violates these Promotion Terms. Disqualification does not limit any other available remedy. Failure to enforce a provision in a particular circumstance does not waive that provision.
7. Releases:
To the fullest extent permitted by law, participants agree to indemnify, release, and hold harmless Sponsor and its directors, officers, agents, representatives, shareholders, employees, successors, and assigns from liability, claims, demands, losses, damages, causes of action, or rights arising from participation in the Promotion, any Promotion-related activity, or the acceptance, receipt, possession, use, or misuse of a discount or prize.
8. General Conditions:
If circumstances beyond Sponsor’s control—including tampering, fraud, natural disasters, governmental action, technical failures, or human error—prevent the Promotion from operating as planned or impair its integrity, Sponsor reserves the right, subject to applicable law, to cancel, terminate, modify, or suspend the Promotion or administer it in an alternative fair and equitable manner.
Notice of any such action will be posted at www.earthburger.com.
9. Dispute Resolution and Governing Law:
To the fullest extent permitted by law, participants agree that:
(a) Any action arising from these Promotion Terms or the Promotion shall be filed exclusively in the applicable federal or state courts serving Bexar County, Texas, and participants consent to those courts’ jurisdiction.
(b) Disputes shall be resolved individually and not as part of a class action.
(c) Claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, if any, excluding attorneys’ fees.
(d) Participants waive claims for punitive, incidental, consequential, multiplied, or increased damages beyond actual out-of-pocket costs.
These Promotion Terms and the rights and obligations of participants and Sponsor are governed by Texas law, without regard to conflict-of-law principles.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR EXCLUSIONS OF LIABILITY OR DAMAGES. THOSE LIMITATIONS MAY NOT APPLY TO YOU.
